South Dakota Directed

 Asset Protection Dynasty Trusts
There is a common misconception that in order to maintain control of an asset, you must have ownership of that asset. With South Dakota Directed Asset Protection Dynasty Trusts, you are able to maintain control of an asset, enjoy that asset, and pass that asset to your heirs. As Grantor of such a trust, you make an irrevocable gift to this unique entity, thereby removing it from your personal financial statement and creating an estate tax free asset for future generations to enjoy.

Below are tools that allow you to retain "control" of the assets that reside outside of your personal ownership and instead reside within your irrevocable trust.

The Trust Protector

A person or Special Purpose Entity that can modify the trust (there are 14 provisions within the SD statutes permitting modifications) so that your trust can adapt with circumstances in the future.

The Investment Committee

Family members can make all of the decisions as to what and how to invest the trust assets.

The Distribution Committee

Family members can help guide the direction of the trust's payouts.

Special Purpose Entities

A Special Purpose Entity (SPE) can direct the administrative trustee as to the trust investments, distributions, and trust protector functions, providing invaluable oversight and safeguarding your assets. At More Than Money Trust Company, many of our clients utilize SPEs to enhance the security and longevity of their trusts. SPEs can help ensure that trusts operate in accordance with the grantor's intentions and withstand unforeseen challenges. Utilizing SPEs as trust protectors can empower you to preserve and manage your wealth effectively, benefiting from South Dakota's robust legal framework.

The Administrative Trustee

With a directed trust, the trustee does not have the power to make any decisions, but rather acts administratively on the decision made by the entities mentioned above.
